A Superior Court judgment does not always mark the end of your case.  A misapplication of the law or the facts may be grounds to take your case up on appeal.   However, the practice of law before the Court of Appeal is very different than practicing in the trial courts.

The appellate attorney must be able to objectively review the record, identify legal arguments, and carefully craft the arguments in a logical, well-written brief.  At the Law Office of Amanda F. Benedict, we have he knoweldge and experience to argue your case to the Court of Appeal.

Serious accidents often occur without warning and most people are unprepared when they or their loved ones suffer a personal injury. Following an accident, people are frequently confucsed regarding their rights and discouraged about getting a fair insurance settlement for the injuries.

Insurance companies aim to give you as little compensation as possible. That is why you need an attorney. We are there to represent your needs, not the insurers' bottom line. What if your injury is permanent? What if you don't have the same ability to earn income as you did before the accident? What if you are plagued by chronic pain after the accident, as so many people are?

The Law Office of Amanda Benedict in Encinitas, California, helps clients recover for their medical expenses, damaged property, and lost wages. We work on a contingency fee basis in bicycle accident and automobile accident cases. You do not pay any attorneys fees unless we recover damages for you.

Do not sign an insurance settlement document without consulting with an attorney. If you would like to talk about your accident with an automobile accident attorney, Contact Us and make arrangements for a free consultation.

What should you do if you are in an accident?

1.  At the scene of the accident, contact the police and get the other driver's insurance and identification information

2.  If you even suspect injury, promptly seek medical attention.

3.  Order a copy of the accident report.

4.  Do not sign any insurance settlement offers without first consulting with a lawyer.

Why Hire A Bike Accident Attorney?
Accidents and injuries can turn your life upside down. Worries about medical bills, your damaged bike, and your recovery can quickly become overwhelming.  Added to those worries is the stress of dealing with the insurance companies and their demands for a quick settlement.

The goal of the insurance companies is NOT to help you. Their goal is to pay you as little as you will take to settle your case. It is tough for someone who is not familiar with bicycle accident cases to know what a fair settlement amount is. An experienced bicycle accident attorney will be your advocate who can help you to negotiate a fair settlement. The insurance companies will not protect your rights.  The insurance companies have attorneys and adjusters whose goal is to pay you as little as they can. You need a bicycle accident attorney on your side who is knowledgable of the laws relating to cyclists and who is willing to fight for your rights.

After an accident, your only focus should be on recovering from your injuries and resuming your life.  As your attorney, my job it to reduce the stress and hassle of dealing with the financial aspect of your bicycle accident. I will take care of the paperwork, phone calls, and questions relating to your claims.  I will also work with the insurance companies, doctors, and experts to help you obtain a fair settlement.

Why Hire A Cyclist As Your Attorney?
As an avid cyclist, I have seen first hand the dangers caused by careless drivers. I have also seen how motorists and authorities try to blame cyclists for accidents even when the motorist was clearly at fault.

I know the expenses involved in cycling and I understand the that athletes require more than the "basics" of medical care to get back to competitive condition.  I will fight to get you fairly compenstated for the damages to your gear and for the rehabilitation you need to resume your active lifestyle.
