- What is Bail?
Bail is an amount of money posted with the court to ensure your next appearance in court if you are released from custody. Call our office to help you save money when using a Bail Bond Company. Bail is set by a bail schedule in each county. You may have the opportunity to request a bail reduction through a bail commissioner. The factors that will be considered are: the seriousness of the offense, any prior failures to appear, previous record, your connections to the community, as well as the probability that you will appear in court. The law presumes you are guilty of the charges for purposes of setting bail or release. You might be released on your own recognizance (O.R.) without payment of bail because the judge believes that you will show up for court appearances.
- What is an arraignment?
You have a constitutional right to be arraigned without unnecessary delay - usually within two court days of being arrested. You will be officially informed of the charges against you at your first arraignment. At the arraignment, an attorney may be appointed for you if you cannot afford one, and bail can be raised or lowered. Then a plea is entered, you can plead guilty, not guilty or no contest to the charges.
- What is a preliminary hearing?
A preliminary hearing is usually within 10 court days of the arraignment. At the preliminary hearing the district attorney's office must present evidence showing a reasonable suspicion that a felony was committed and that you did it to convince the judge that you should be brought to trial.
